BDIX HOST provides web services to customers globally. By using our services, clients agree to abide by the following Terms of Service. These terms ensure that all users receive reliable and high-quality services. The BDIX HOST logo and website content are our intellectual property and must not be used without permission.

1. Account Setup

New accounts are activated once payment has been received and successfully verified. We also conduct fraud screening before finalizing the account setup. Customers must provide an email address unrelated to the domain they are registering. This email will be our primary mode of communication in case of any service issues.

If you have registered a domain with BDIX HOST, you must ensure that all contact details in your account are accurate. We are not responsible for domain expiration due to incorrect or outdated contact information. Clients must keep their records updated through their client dashboard. If false details are provided, we reserve the right to suspend or terminate the account.

2. Website Transfers

Our team offers free website migration services for customers switching to BDIX HOST. However, not all hosting platforms are compatible, and some data formats may not transfer properly. We strive to complete transfers efficiently but cannot guarantee success in every case. The free migration service is available for up to three days from the account activation date.

3. Satisfaction Guarantee

BDIX HOST offers a 7-day money-back guarantee on web hosting services. If you are dissatisfied with our services within the first seven days, you can submit a cancellation request. A valid reason must be provided for the cancellation. If we determine that reasonable efforts were not made to resolve the issue before requesting cancellation, a refund may not be issued. Refunds will also not be given if the terms and conditions were violated. Once a refund is claimed and canceled, another request cannot be made.

4. Payment Policies

All BDIX HOST services operate on a pre-paid basis, covering domains, hosting, SSL certificates, spam filtering, and other IT-related services.

Invoices can be paid through Aamarpay, bKash, PayPal, Bank Transfer, and in-person payments at our office. Online payments may include additional gateway fees, which are automatically added during checkout.

Renewal reminders are sent multiple times via email, starting 30 days before the due date. Failure to make timely payments may lead to service interruptions.

For overdue accounts, the following actions apply:

  • Day 1: No action taken
  • Day 3: Account suspension
  • Day 5: Late fees applied
  • Day 7: Permanent account termination

5. Service Cancellation

Clients can cancel their services anytime by submitting a cancellation request via the client portal.

6. Overage Charges

Hosting plans are designed to accommodate most users’ needs, but additional charges apply if your usage exceeds the allocated limits, such as storage or bandwidth. Customers will receive automated notifications when usage nears the limit. If a client fails to upgrade their plan or adjust their usage, the system may suspend the account until action is taken.

7. Refund & Account Termination Policies

BDIX HOST offers refunds only in specific cases. If a service is not delivered as promised, a partial refund may be issued. However, refunds will not be granted if the terms of service were violated, leading to account suspension or termination.

If a client requests service cancellation, the account will first be suspended and then permanently deleted after seven days. If an account remains inactive due to non-payment, it will also be deleted after seven days. Clients with multiple accounts must clear all outstanding balances before any suspended services can be restored.

Refund exclusions:

  • Domain registrations and transfers are non-refundable.
  • VPS and Dedicated Server plans do not qualify for refunds.
  • If services are canceled, suspended, or terminated due to a policy violation, no refund will be issued.
  • Credit balance in a client account is non-refundable and can only be used for purchasing services.
  • Cancellation requests must be submitted via the client area. Other methods will not be accepted.
  • Once a cancellation request is processed, the account cannot be reactivated. A new purchase is required.
  • Refund processing may take up to seven days, depending on the payment method. Gateway fees and transfer charges will be deducted.
  • If a refund is requested as account credit, it cannot be later withdrawn as cash.

By using BDIX HOST services, customers acknowledge and agree to these terms. We reserve the right to update the Terms of Service at any time.

8. CONTENT

All services provided by BDIX HOST must be used for lawful purposes only. Transmission, storage, or presentation of any information, data, or material that violates United States Federal, State, or Bangladesh Government laws is strictly prohibited. This includes, but is not limited to, copyrighted material, content deemed threatening or obscene, material jeopardizing national security, or data protected by trade secrets. The subscriber agrees to indemnify and hold BDIX HOST harmless from any claims resulting from the subscriber’s use of BDIX HOST’s services that may cause damage to the subscriber or any other party.

BDIX HOST supports freedom of speech; however, the following types of content will result in immediate suspension of service:

  • Racist, hateful, or prejudicial content based on color, creed, or belief.
  • Profanity or obscene language directed at anyone except oneself.
  • Violent or malicious content.

Customers must self-govern their content and take responsibility for their website’s material. BDIX HOST does not actively monitor hosted content. However, if notified of questionable material, BDIX HOST will address concerns directly with the customer to seek an amicable resolution. If a complaint involves copyrighted material or illegal activity, legal documentation is required before BDIX HOST takes further action.

BDIX HOST prohibits the following on shared hosting plans:

  • Web proxy services/scripts.
  • File hosting services.
  • Remote uploading/processing scripts such as Rapid Leech, Phpmusicsearch, Rapidshare premium link generators.
  • Torrent seeding using Torrent Flux or similar scripts.
  • Image/video hosting sites that consume excessive CPU or server memory.
  • Video streaming using FFMPEG or similar formats.

On shared hosting accounts, media files (MP3/music, images, videos, etc.) under 20MB may be hosted if linked to HTML/script files for website functionality. However, media files must not exceed 10% of total hosted files. Exceeding this limit may result in immediate termination without notice. These restrictions do not apply to VPS or dedicated server plans.

Examples of prohibited content or activities include:

  • Topsites, IRC scripts/bots, proxy scripts.
  • Pirated software, warez, or illegal downloads.
  • AutoSurf/PTC/PTS/PPC sites, IP scanners, VPN services.
  • Brute force programs, mail bombers, or spam scripts.
  • Ponzi schemes, HYIP, FOREX, and similar investment fraud.
  • Sites promoting illegal activities, hacking, or harassment.
  • Forums distributing illegal content.
  • Unauthorized third-party network access.

Using a shared hosting account as a backup/storage device is prohibited. Shared hosting accounts are for website storage only, not for remote file storage applications such as File Cloud, OwnCloud, or NextCloud. Violation of this policy may result in account suspension or termination. These restrictions do not apply to VPS or dedicated server plans.

BDIX HOST reserves the right to refuse service to anyone. If material is found to be obscene, illegal, or in violation of these terms, BDIX HOST may remove it without notice. Failure to respond to abuse department inquiries within 48 hours may result in service suspension or termination.

9. ZERO-TOLERANCE SPAM POLICY

BDIX HOST enforces a strict zero-tolerance policy on Unsolicited Commercial Email (UCE) and Unsolicited Bulk Email (UBE), commonly known as spam. Spam is defined as any email meeting the following criteria:

  1. Sent to multiple recipients without their consent.
  2. Sent without verifiable and explicit permission.
  3. Provides disproportionate benefit to the sender.

Customers sending unsolicited emails may face service suspension upon confirmation of abuse. Spam increases server strain and risks blacklisting. Customers running mailing lists must:

  • Provide clear sender identification.
  • Disclose email collection methods.
  • Include an easy unsubscribe mechanism.
  • Provide valid non-electronic contact details.
  • Send only to consenting recipients.

Sending UBE via BDIX HOST servers or promoting a BDIX HOST-hosted website through spam is prohibited. Mailing lists must be closed-loop, requiring subscribers to confirm subscriptions. Purchased email lists are not allowed.

10. SCRIPT USAGE POLICY

BDIX HOST allows CGI files, PHP scripts, and executable programs on hosting accounts. However, these scripts must adhere to the following conditions:

  • Scripts must use minimal system resources.
  • No account may use more than 20% of system resources at any time.
  • Excessive resource consumption may result in service suspension.
  • BDIX HOST reserves the right to disable scripts affecting server stability.

Failure to comply with these terms may result in suspension or termination of services without notice. Customers uncertain about compliance should contact BDIX HOST for clarification.

11. RESOURCE USAGE POLICY

11. a) Server Resource Abuse Policy (SRAP):
Any website on our shared servers that uses a high amount of server resources (CPU, memory usage, and network resources) will be given the option to pay for a dedicated server. The abuse and misuse of system resources is a serious problem, and BDIX HOST does not tolerate it. Accounts on a shared server must be shared with other users, so we must limit how much of the CPU and memory can be used by any one account.

In all fairness, we cannot allow one or two clients to use all of the system resources on a shared machine and have all other clients suffer because of it. Excessive CPU & memory usage by one or more clients causes extreme slowness in all areas: MySQL, Email, HTTP, and more. If the CPU & memory usage by a few clients gets out of hand, all sites hosted on the machine will return errors and not be accessible in any way.

AVERAGE SERVER RESOURCE LIMITS

  • Memory usage may not exceed 10% per account/file/application.
  • CPU usage differs in the different shared hosting plans, which are found on their plan details page.
  • Apache connections may not exceed 30 connections.
  • 15 MySQL maximum user connections allowed.
  • 250 emails per hour, per domain.
  • Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
  • Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
  • Run any software that interfaces with an IRC (Internet Relay Chat) network.
  • Run any bit torrent application, tracker, or client. You may link to legal torrents off-site but may not host or store them on our shared servers.
  • Participate in any file-sharing/peer-to-peer activities.
  • Run any gaming servers such as Counter-Strike, Half-Life, Battlefield 1942, etc.
  • Run cron entries with intervals of less than 15 minutes.
  • When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”), use include(“include.php”).

11. b) Illegal Usage:
BDIX HOST servers may be used for lawful purposes only. Transmission, storage, or distribution of any information, data, or material in violation of any applicable law or regulation is prohibited. This includes, but is not limited to, copyrighted material, trademarks, trade secrets, or other intellectual property rights used without proper authorization, and material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws. Examples of non-acceptable content or links: pirated software, hackers’ programs or archives, warez sites, MP3, and IRC bots. Any type of forum/discussion board discussing where to obtain such files or one that distributes the files is also prohibited. The subscriber to BDIX HOST service agrees to indemnify and hold harmless BDIX HOST from any claims resulting from the use of the service that damages the subscriber or any other party. BDIX HOST will be the sole arbiter as to what constitutes a violation of this provision.

11. c) Illegal Content:
BDIX HOST does not allow background daemons such as IRC bots, eggdrop, BitchX, XiRCON, and any other program that interferes with normal server operation. No warez is allowed. Web proxies are not tolerated. This includes NPH-Proxy and web proxy. If your site is found to hold any proxy files, your account will be suspended and the account holder will be issued a fee of $50 USD. When using an account with shell access, you are not allowed to run ANY servers or services on the BDIX HOST network. Servers are defined as perlbots, proxies, BitchX, psyBnc, root exploits, DDoS scripts, Shoutcast servers, etc. Running any of these will face an immediate suspension, and users will be subject to a fine no less than $50.00 USD, and no more than $100.00 USD. BDIX HOST reserves the right to terminate an account for these activities also.

11. d) Software Distribution:
BDIX HOST web hosting accounts are not to be used for the purposes of distributing software and multimedia products. If you wish to distribute software and/or multimedia files, please contact our sales team for special arrangements.

11. e) Chat Rooms:
BDIX HOST does not provide nor allow chat rooms on a shared hosting environment. You may elect a dedicated server to run a chat room efficiently.

11. f) IRC:
BDIX HOST does not allow IRC or IRC bots to be operated on our shared or reseller servers. They are allowed on dedicated servers provided that no negative effects occur to our network.

11. g) Liabilities:
BDIX HOST makes no endorsement, claims, or promises regarding the services offered by our customers and will not be held liable for any disputes or claims against said customers. In no event shall BDIX HOST be liable for any direct, indirect, incidental, consequential, special, and exemplary damages, or any damages whatsoever, arising from the use or performance of this website or from any information, services, or products provided through your website. We are not responsible for any content on any server in our network and will not take any action against any questionable material or action until the website in question is brought to our attention by emailing us.


12. IP ADDRESS OWNERSHIP

BDIX HOST shall maintain and control ownership of all IP numbers and addresses that may be assigned to you by BDIX HOST. BDIX HOST reserves the right to change or remove any and all such IP numbers and addresses at any time.

13. Security Violations

Users are strictly prohibited from engaging in any actions that compromise the security of the BDIX HOST network. Any violations of system or network security may lead to legal consequences, including civil and criminal liability. BDIX HOST will investigate such activities and may collaborate with law enforcement authorities to prosecute offenders. Examples of prohibited actions include but are not limited to:

  1. Gaining access to data or logging into an account or server without proper authorization.
  2. Attempting to test, probe, or scan system vulnerabilities or bypass security measures without permission.
  3. Intentionally interfering with the functionality of services, servers, or networks through actions such as overloading, flooding, or mail bombing.
  4. Altering any TCP/IP packet header or any part of the header information in emails or forum posts.
  5. Taking actions to access services that the user is not entitled to receive.
  6. Purchasing multiple hosting packages to combine bandwidth or storage for unfair advantage. Each hosting plan is intended for a specific domain and purpose. BDIX HOST will identify such actions as deceptive and prevent them. Users should explore upgrade options or consult with BDIX HOST for special arrangements.

Any breach of system or network security is strictly forbidden and may result in severe consequences. Examples of such breaches include unauthorized access, probing, scanning, or exploiting security vulnerabilities. Disrupting services through deliberate system overloads, mail bombing, or flooding is also prohibited. Additionally, forging TCP/IP packet headers in emails or newsgroup postings is a violation.

14. Server Abuse

Any attempt to harm BDIX HOST’s servers or its users is strictly prohibited. Examples of such activities include:

  • Logging into unauthorized accounts or servers.
  • Gaining access to data or services not intended for the user.
  • Scanning or probing system vulnerabilities without permission.
  • Hacking, modifying, or attempting to bypass authentication or security measures.
  • Uploading or transmitting malware, including viruses, Trojan horses, worms, or any software designed to disrupt system functionality.
  • Interfering with data transmission, intercepting information, or attempting unauthorized access.
  • Intentionally disrupting services through overloading, flooding, mail bombing, or crashing systems.

Users are fully responsible for all actions performed through their accounts, whether carried out by themselves or others. All sub-networks and dedicated servers under BDIX HOST must comply with these policies.

15. Bandwidth and Traffic Usage

Effective from January 11, 2020, all bandwidth and traffic allowances for BDIX HOST plans, including shared, VPS, and dedicated hosting, are calculated as a sum of incoming and outgoing data. The total allowance is split evenly between incoming and outgoing traffic. If a user exceeds either limit, additional usage will be charged according to their plan’s overage rate.

For shared hosting plans, exceeding allocated bandwidth may result in account suspension. Users may receive prior warnings via email and could be contacted for resolution options.

For VPS and dedicated servers, BDIX HOST does not guarantee a minimum bandwidth allocation on shared ports. However, users can opt for a dedicated bandwidth port, which offers a 75% minimum guarantee up to the upstream provider’s Singapore/UK data center for international bandwidth and 100% within local IX networks. Pricing for dedicated bandwidth is available upon request from BDIX HOST’s sales team.

16. Scheduled Maintenance

BDIX HOST strives to maintain 24/7 service availability. However, users acknowledge that services may be temporarily unavailable due to periodic maintenance, upgrades, or unforeseen issues such as network congestion or security attacks.

BDIX HOST will notify users at least 48 hours in advance for scheduled maintenance. While we will make reasonable efforts to minimize downtime, BDIX HOST is not liable for disruptions caused by external factors beyond our control. The 99.99% uptime guarantee does not apply to shared hosting accounts.

17. Client Responsibilities (Including Resellers)

Users are responsible for all activities performed through their accounts unless they can prove unauthorized access due to hacking or identity theft. Users must safeguard their login credentials and are accountable for any third-party content uploaded to their hosting space.

Using BDIX HOST services requires a certain level of technical knowledge, depending on the intended usage. Examples include:

  • Web Publishing: Familiarity with HTML, FTP, and file management.
  • FrontPage Publishing: Understanding of FrontPage tools and FTP.
  • CGI-Scripts: Knowledge of UNIX commands, Perl, and scripting languages.
  • Email Management: Proficiency in configuring and managing email clients.

Users must acknowledge that BDIX HOST is not responsible for providing technical knowledge or support beyond the functionality of its own servers. Clients must ensure they have the necessary expertise to manage their hosting services effectively.

18. BACKUPS

BDIX HOST takes significant measures to maintain system integrity. However, BDIX HOST shall not be liable for any data loss due to any reason. To ensure maximum data security, BDIX HOST strongly advises all users to periodically back up their data on their personal devices as needed. Data that holds high importance should always be stored in multiple locations.

BDIX HOST offers automated complimentary remote data backup exclusively for shared hosting users. However, this does not include any guarantee of data consistency. Any account exceeding 50 GB of data is not covered under this complimentary backup feature. This backup system is primarily intended to restore data in case of hardware or service failure on the shared hosting server and is not meant to recover user-generated errors.

For VPS, VDS, and Dedicated Server users, no backup solution is included by default. BDIX HOST does not retain any data backup for VPS, VDS, or Dedicated Server users for disaster recovery purposes. Therefore, customers must establish their own backup strategy.

Backup solutions can be arranged through third-party vendors at an additional cost, subject to the terms and conditions of the third-party provider.

19. ACTIONS

Failure to comply with any of the above policies may result in account suspension or termination. BDIX HOST will be the sole judge in determining violations of the Acceptable Use Policy (AUP) and reserves the right to remove accounts without prior notification.

Upon detecting a possible AUP violation, BDIX HOST will conduct an investigation. During this process, BDIX HOST may limit customer access to prevent unauthorized activity. Depending on the severity of the breach, BDIX HOST may restrict, suspend, or terminate the hosting account and may also take legal action. If a violation involves criminal activity, BDIX HOST will notify the relevant law enforcement agencies.

BDIX HOST does not provide credits or refunds for service outages resulting from AUP violations.

Customers agree to indemnify BDIX HOST against any claims arising from their use of BDIX HOST services that may cause harm to themselves or third parties. BDIX HOST services are provided “as is” and “as available” without any express or implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. BDIX HOST does not guarantee uninterrupted, error-free, or secure service. No verbal or written information provided by BDIX HOST, its employees, or partners shall create a warranty. BDIX HOST and its affiliates shall not be liable for any losses, damages, or costs resulting from the use of the service.

20. MODIFICATION

BDIX HOST reserves the right to modify, add, or remove any part of this policy at any time without prior notice.

21. REFUSAL OF SERVICE

BDIX HOST reserves the right to refuse, cancel, or suspend services at its sole discretion. If an account repeatedly violates company policies after warnings, BDIX HOST may suspend the account. This is especially applicable in cases of spam activities or script abuse.

Additionally, if a customer becomes unreasonably difficult, unprofessional, or threatening, BDIX HOST may suspend their account and recommend switching to another hosting provider. A backup of the account may be provided in such cases.

Exceptions to these rules will be evaluated on a case-by-case basis. If a server becomes unstable due to excessive usage from an account, BDIX HOST reserves the right to suspend the account to maintain server stability. If usage continues to increase, BDIX HOST may recommend upgrading to a dedicated server.

22. AFFILIATE PROGRAM

Affiliate marketers will not receive commissions if they purchase a service using an affiliate link from an account on their own device.

GENERAL TERMS

  • These Terms of Service are subject to change without prior notice.
  • The Terms of Service form a legally binding agreement between BDIX HOST and the subscriber.
  • By creating an account, users agree to comply with these terms.
  • Any matters not explicitly mentioned in these terms are subject to interpretation and modification by BDIX HOST administrators without prior notice.
  • All prices, except those covered by a 7-day money-back guarantee, are non-refundable and non-negotiable.
  • Violation of these terms will result in account termination without prior notification.
  • BDIX HOST reserves the right to terminate accounts with a 7-day prior notice.
